2. Sending a copyright-infringement notice

If you own a copyright or are authorized to act for its owner and believe material on GulfWire infringes it, send a written notice to the designated agent containing all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at a single online site are covered by one notice.
  3. Identification of the allegedly infringing material to be removed or disabled, with information reasonably sufficient to locate it, such as a specific report link or content identifier. Identify each item clearly.
  4. Information reasonably sufficient to contact you, including your mailing address, telephone number, and email address, if available.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Consider whether fair use or another legal authorization applies before sending a notice. GulfWire LLC will review notices and respond expeditiously to valid notices, including by removing or disabling access to the identified material where required. We may request missing information and will take reasonable steps to notify the affected user of removal or disabled access.

3. Counter-notifications

If your material was removed or disabled and you believe this resulted from mistake or misidentification, you may send a written counter-notification to the designated agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number; a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which GulfWire LLC may be found; and a statement that you will accept service of process from the person who provided the original notice or that person's agent.

Upon receiving a valid counter-notification, we will provide a copy to the original complaining party and inform them that we will replace the removed material or cease disabling access in 10 business days. We will replace the material or cease disabling access not less than 10 and not more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the user from infringing activity relating to the material on our service. Material may remain unavailable for separate, lawful reasons under our Terms.

4. Repeat infringers and rights-management measures

GulfWire LLC's policy is to terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also restrict or terminate access for other copyright violations consistent with applicable law and our Terms. We consider the circumstances, including valid notices, counter-notifications, and relevant outcomes; this policy does not promise an automatic strike count. GulfWire LLC accommodates and does not interfere with standard technical measures as defined in 17 U.S.C. § 512(i).

5. Accuracy and handling of notices

Knowingly materially misrepresenting infringement, or that material was removed or disabled by mistake or misidentification, may result in liability for damages, costs, and attorneys' fees under 17 U.S.C. § 512(f). Seek independent legal advice if you are unsure of your rights.

Notices and counter-notifications, including contact details, may be shared with the affected user or complaining party as necessary to follow this process or comply with law. Do not include passwords, payment information, or unrelated sensitive information.
